LEGAL TERMS AND CONDITIONS
This notice contains the legal terms and conditions governing the www.etonic1876.com website (hereinafter referred to as the "Site"). By accessing the site users undertake to accept and agree to abide by all the conditions contained in this declaration. Sport Commerce Italia S.r.l. reserves the right to ask the Users who do not accept or do not intend to respect these terms, to refrain from using the website. The access to the site and to the related services is intended exclusively for personal use. The site is the property of Sport Commerce Italia S.r.l.. At any time Sport Commerce Italia S.r.l. may modify the contents of the site itself, including the commercial conditions expressed therein, without giving any notice. Sport Commerce Italia S.r.l. declines any responsibility regarding the possibility that, due to a particular configuration of the computer used by the Customer or to a malfunction of the same, the colours of the products displayed on the site may slightly differ from the original ones.
CONDITIONS OF SALE
The sale of the products contained in the virtual catalogues present on this site (hereinafter referred to as "Products") is regulated by the following General Terms and Conditions of Sale formulated in compliance with the regulations on contracts concluded outside of business premises. Sport Commerce Italia S.r.l. is authorized by ETONIC Holdings, LLC (hereinafter referred to as the "Company") to manage an e-commerce system. For the purposes of the sales of the above mentioned products, the Company has no power of representation of Sport Commerce Italia S.r.l. towards purchasers ("Customers"). As a consequence, Sport Commerce Italia S.r.l. is the only entity responsible towards the Customers themselves, being the company expressly excluded from any liability for any reason whatsoever. The sales contract can be concluded in the following languages: Italian, English and French.
CONTRACTORS
The sale and purchase contract shall be understood to be between: Sport Commerce Italia S.r.l. with registered office in Via Piazzon 102, 36051 Creazzo - Italy, VAT number and company registry entry 03529690244 - registration to the R.E.A. of the C.C.I.A. number VI - 332567. Customer: the person (natural or legal person) who through the site has sent an order which has been accepted by Sport Commerce Italia S.r.l. The application of any other contractual conditions is excluded, even if not expressly disavowed by Sport Commerce Italia S.r.l..
APPLICATION OF THE GENERAL CONDITIONS OF SALE
Before making a purchase, the Customer is invited to read these General Terms and Conditions carefully and is authorised to save, reproduce, download a copy and/or print them. For any further information, the Customer is invited to contact the site's customer service at info@sportcommerceitalia.com. By completing the formalities set out to place the purchase order, the Customer declares that he/she has read the formalities and accepts the General Terms and Conditions of Sale in full. The general sales conditions may be modified over time by Sport Commerce Italia S.r.l. and any modification will become valid with the publication on the website. The conditions in force at the time of purchase shall be applicable to each contract.
DESCRIPTION OF THE SALE OF PRODUCTS
The service for the sale of Products activated on the Site comprises registration, access to the selections, the choice of Products, the on-line transmission of the purchase order and the possible on-line acceptance of the purchase order.
Registration:
The purchase and/or registration entails acceptance of the General Conditions indicated above that govern the contract for the supply of Products, as well as consent to the processing of one's personal data. In the event of registration, the Customer is obliged to keep his password with the utmost diligence, undertaking not to allow the use of the service by third parties not expressly authorised by him, for whose conduct on the network he assumes all responsibility. In the event of loss, theft or loss of the password, the Customer shall be entitled to activate the procedure for issuing a new password on the Site. If the Customer wishes to delete his account, he must send this request to the Customer Service e-mail address.
Purchase order:
Every purchase order received by Sport Commerce Italia S.r.l. must clearly contain indications of the Product code, description of the same, quantity, address and name of the addressee. The ordering procedure on the Site provides the possibility to identify and correct data entry errors before the forwarding of the purchase order. The purchase order sent by the Customer constitutes a binding contractual proposal for the Customer. To confirm the receipt of the order, Sport Commerce Italia S.r.l. shall send the Customer a summary e-mail to the e-mail address indicated in the registration. The e-mail is for information purposes only and does not constitute acceptance by Sport Commerce Italia S.r.l. of the order.
Acceptance of the purchase order and conclusion of the sale contract:
Sport Commerce Italia S.r.l. reserves the unquestionable right to accept or reject the purchase order forwarded by the Customer. Sport Commerce Italia S.r.l., without prejudice to the following paragraph, commits itself to carry out the order of the Customer or to inform him of any problem, without delay and in any case within and no later than 7 (seven) days starting from the day following the day on which the Customer has transmitted the order. It is understood that the execution of the order is subject to the actual availability of the Products. In case of lack of availability of the Product and/or in case of non-acceptance of the order Sport Commerce Italia S.r.l. shall promptly inform the Customer and refund the same if the payment has already been made. In this case the Customer shall not be entitled to any other indemnity or compensation. Orders transmitted by persons who have not reached the age of majority shall not be accepted.
Procedure for archiving the sales contract:
The sales contract will be archived on the Site and the Customer may access it at any time by following the viewing procedure on the Site.
CHARACTERISTICS OF PRODUCTS
The Products are depicted in the Online Catalogue in such a way as to correspond as closely as possible to their exact characteristics. The images published as general information material may not exactly correspond to reality. The Products shown in the on-line catalogue can be purchased while stocks last, it being understood that Sport Commerce Italia S.r.l. reserves the right not to make available, at any time, some Products and/or to modify their characteristics. Sport Commerce Italia S.r.l. also reserves the right to update, at any time, the on-line catalogue, modifying the range or the number of products.
PRICES AND CURRENCY
The price of the Products is that resulting from the Price List published on the Site and in force at the time the order is transmitted by the Customer. The prices of the Products published on the Site are understood to include standard packaging and/or wrapping and VAT (with the exception of Non-EU countries), the rate of which is determined in relation to the type of Product. Prices do not include transport and delivery costs. All the aforementioned costs (delivery and packaging/special packaging), not included in the prices of the Products published on the Website, will be separately indicated in the order summary and confirmed in the order acceptance e-mail which will be sent to the customer by Sport Commerce Italia S.r.l.. In addition, for deliveries to be made in EU countries other than Italy and in the Other States, Campione d'Italia, Livigno, Channel Islands and Canary Islands, the prices of the Products published on the website shall always be understood as not including
any taxes and/or sales taxes.

The Customer shall be liable to pay all taxes and customs duties applicable in the country of delivery of the Products ordered. Any and all charges or costs relating to customs clearance of the Products delivered shall remain the sole responsibility of the recipient of the delivery. Orders are invoiced in the currency of the country to which you are interested in shipping. The amount that will be charged to your credit card may vary as it is based on fluctuating exchange rates and bank fees. Customers are encouraged to contact their banking institution for detailed information on exchange rates and bank fees related to their transaction.
PAYMENT BY CREDIT CARD
Payment by credit card of the Visa, MasterCard and Maestro circuits shall be made online, at the time of transmission of the purchase order. The Customer will be asked to provide his or her credit card details in the purchase order, and the request to debit the corresponding amount will only be made when the order is completed. The Customer's credit card data sent during the transmission of the purchase order are not accessible either to Sport Commerce Italia S.r.l. or to third parties and are received, in a protected manner against unauthorized access, on the secure servers of Shopify which takes care, on behalf of Sport Commerce Italia S.r.l. of credit card payments. When Sport Commerce Italia S.r.l. receives the payment confirmation, it will proceed with the preparation and execution of the purchase order. Credit Card Security:
As all transactions are processed by Shopify, Customers are guaranteed maximum security on their purchase. Customer Service operators are in no way authorised to request or accept credit card numbers and/or credit card validity details.
RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the Contract exercisable within 14 (fourteen) days from receipt of the purchased goods. The Customer must carry out the procedure for requesting authorisation to return the goods present in the reserved area and specified here. The return must be made according to our procedure and by DHL courier for all orders. The collection can be booked by filling in the return form in the reserved area. The shipment must be sent to the following address: C.A.S.H. srl, Via Verdi 37, 30030, Pianiga, (VE), Italy.
The Customer must return, at his or her own care and risk, the purchased Products, intact and complete (including any original packaging of the item), to the address indicated above, within and no later than 14 (fourteen) days from receipt of the purchased Products. For the sole purpose of the 14 (fourteen) days deadline mentioned above, the Products shall be deemed to have been returned at the time they were handed over to the forwarding agent. Withdrawal may be exercised for the entire Product purchased and cannot therefore be exercised in relation to only part of the goods ordered.
Condition:
The garments must not have been worn, washed or altered and must not show any signs of use.
Each item must be returned including all original labels, packaging and accessories received with the order. All footwear and accessories must be returned together with their original box, which is considered to all intents and purposes an integral part of the product itself and must not have been damaged and/or altered in any way.
In the event that the customer receives defective merchandise, or that there are errors in the shipments by Sport Commerce Italia S.r.l., it is requested to follow the same instructions above (return). Sport Commerce Italia S.r.l. reserves the right to request photographic evidence before authorizing returns for defective merchandise and to bear the shipping costs for the return of the merchandise to its premises.
All returned items are subject to inspection and must comply with all the parameters listed in the return procedure.
Sport Commerce Italia S.r.l. reserves the right to refuse unauthorized returns or returns sent with couriers other than DHL unless previously authorized by the customer service. The authorisation must be requested by email to the customer service address.
The return must be delivered to the courier already packed so that it can be transported without damaging the items inside.
Upon verification of the integrity of the product (as per General Terms and Conditions), the cost of the item/s will be reimbursed while the shipping costs paid at the moment of purchase will be retained by Sport Commerce Italia S.r.l.. In all cases in which the withdrawal is not legitimately and validly exercised by the Customer, Sport Commerce Italia S.r.l. will return the Product to the Customer, at the latter's risk and expense; the Customer shall also take care of the organization for the return of the goods. In the event that the returned Products are damaged during transport to Sport Commerce Italia S.r.l., the Customer will be informed of the damages detected within the second working day from the receipt of the Products, in order to allow the Customer to inform the forwarding agent and to claim against the latter and, at the same time, the Customer will return the Products damaged during transport, at the Customer's risk and expenses. In case the withdrawal is exercised according to the provisions of the regulations in force, Sport Commerce Italia S.r.l. will refund the amounts paid by the Customer. The refund of the accepted returns will take place free of charge, in the shortest time possible and in any case within fourteen days from the date in which Sport Commerce Italia S.r.l. received confirmation from its warehouse of the arrival and acceptance of the return.
Sport Commerce Italia S.r.l. will not give notice of the delivery of the returned goods in its warehouses by the courier, the customer can personally inform himself of the delivery through the forwarding agent to whom the return shipment has been entrusted.
